Central Pollution Control Board (CPCB) NOC

CPCB is a statutory body established in September 1974 under the Water (Prevention & Control of Pollution) Act, 1974. Later it was also given powers and functions under the Air (Prevention & Control of Pollution) Act, of 1981. The significant functions of CPCB are Air Quality Monitoring and Water Quality Monitoring. It also coordinates the affairs of other State Pollution Control Boards, assists them, furnishes guidance, and helps in conflict resolution in case of any disagreement among them. CPCB has delegated its powers and functions under the Water (Prevention & Control of Pollution) Act, 1974, the Water (Prevention & Control of Pollution) Cess Act, 1977, and the Air (Prevention & Control of Pollution) Act, 1981 to the respective regional administration with respect to Union Territories. CPCB clearances, CPCB registration, CPCB certification, CPCB NOC, CPCB license, CPCB authorization, CPCB consultant, CPCB certificate.

Air Quality Management

A pan India programme of ambient air quality monitoring is the called National Air Quality Monitoring Programme (NAMP). The network consists of 804 operating stations covering 344 cities/towns in 28 states and 6 Union Territories of the country.

Under NAMP, four air adulterants viz ., Sulphur Dioxide (SO2), Oxides of Nitrogen as NO2, Respirable Suspended Particulate Matter (RSPM / PM10) and Fine Particulate Matter (PM2.5) have been recognised for regular monitoring at all the localities. The monitoring of adulterants is carried out for 24 hours (4-hourly sampling for gaseous pollutants and 8-hourly sampling for particulate matter) with a frequency of twice a week, to have 104 observances in a year.

National Air Quality Index: Air Quality Index is an instrument for efficacious communication of air quality status to people. It transforms complicated air quality data of different pollutants into a single number (index value), title and colour. There are six AQI categories, namely Good, Satisfactory, Moderately polluted, Poor, Very Poor, and Severe. Each of these categories is decided grounded on ambient concentration values of air pollutants and their likely health impacts. AQ sub-index and health impacts are given for eight pollutants (PM10, PM2.5, NO2, SO2, CO, O3, NH3, and Pb) for which short-term (up to 24-hours) National Ambient Air Quality Standards are specified.

Water Quality Management

National Water Quality Monitoring Programme: Central Pollution Control Board (CPCB) in collaboration with State Pollution Control Boards (SPCBs) in the States and Pollution Control Committees (PCCs) in Union Territories developed a National Water Quality Monitoring Network (NWMP) in order to assess the status of water quality and to provide for abatement and control of pollution in water bodies. The present network under NWMP consists of 4111 stations on surface and groundwater in 28 States and 8 Union Territories. Monitoring is carried out with a frequency on a monthly, quarterly, half-yearly and yearly basis. Water samples are analysed for different parameters, trace metals and set of pesticides as per the Guidelines on Water Quality Monitoring, 2017 issued by MoEF&CC.

Waste Management

• Hazardous Waste

“Hazardous waste” means any waste which is dangerous or may cause danger to health and the environment because of its physical, chemical, biological, reactive, toxic, flammable, explosive or corrosive characteristics. Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 are notified by CPCB to deal with Hazardous waste. Authorization is to be obtained by the concerned SPCB. 

• E-Waste

'e-waste' means electronic equipment, discarded as waste by the consumer or bulk consumer and the rejects from manufacturing, refurbishment and repair process. The manufacturer should apply for authorisation in conformance with the procedure specified by the concerned State Pollution Control Board, which shall give the authorisation in conformance with Form 1 (bb). Producer shall apply to the Central Pollution Control Board for authorisation in Form 1, which shall, later on, grant the Extended Producer Responsibility - Authorisation in Form 1(aa). The Central Pollution Control Board after entitlement of Extended Producer Responsibility - Authorisation shall forward the Extended Producer Responsibility Plan to the respective State Pollution Control Board for monitoring. The renewal of the Extended Producer Responsibility-Authorisation application is to be made in Form-1 before 120 days of its expiry to Central Pollution Control Board. After receiving a compliance report from the concerned SPCB which has to submit the compliance report to CPCB within 60 days, CPCB may renew the authorisation for a period of five years.

• Municipal solid waste

CPCB has laid down the Solid Waste Management Rules, 2016 for the management of municipal solid waste. The Ministry of Environment, Forest and Climate Change is liable for overall monitoring and implementation of these rules. CPCB coordinates with the State Pollution Control Boards and the Pollution Control Committees for implementation of these rules and adherence to the specified norms by regional authorities.

• Bio-medical Waste

According to Bio-medical Waste Rules, 2016, all occupiers or operators handling bio-medical waste, irrespective of the quantity are mandated to obtain authorisation from the concerned State Pollution Control Board and Pollution Control Committee. The Central Pollution Control Board monitors the implementation of these rules in case of all the Armed Forces health care establishments under the Ministry of Defence.

• Plastic Waste

Producers, Importers, and Brand-owners (PIBOs) and Plastic Waste Processors which are operating in one or two states must register themselves with the concerned SPCB/PCC through a centralized EPR portal developed by CPCB.

PIBOs functioning in more than two states and plastic waste processors must register themselves with CPCB through a centralized EPR portal developed by CPCB.

Registration is granted for one year initially and subsequently granted for three years.

• Batteries Management

In accordance with Batteries (Management and Handling) Rules, 2001, the prescribed authority for ensuring compliance with these rules is the State Board. SPCB should file an annual compliance status report to CPCB annually. It is the responsibility of CPCB to collect, assemble and publish the data received from the State Boards annually. In order to improve the collection and recycling of used batteries, CPCB reviews the compliance of the rules regularly.

• Construction and Demolition Management

Under Construction and Demolition Waste Management Rules, 2016 the duties of the Central Pollution Control Board are – 

1. Preparing guidelines related to environmentally sound management of the construction and demolition waste.
2. Assemble and analyse data received from SPCB/PCC.
3. Coordinate with all SPCB/PCC for matters related to the development of environmental standards.
4. Send the annual compliance report to Central Government.

• Contaminated Sites

There are numerous contaminated dumpsites in different parts of the country where hazardous and other wastes had been dumped, which led to contamination of soil, groundwater and surface water thereby causing health and environmental risks. The concerned SPCB/PCC must guide the parties responsible for contaminating the site to carry out an investigation and then remediate it scientifically as per the guidance document handed by CPCB

• Industrial Pollution

242 industrial sectors are categorized by CPCB into the Red, Orange, Green, and White categories. SPCB/PCC is mandated to adopt and implement this categorization. In addition, SPCB/PCC can add more industrial sectors into their respective list as the need may be. Based on this classification, industries are given CTO and CTE on an application for the same.

CPCB developed the CEPI to find out an Indicator value to assess the quality of the environment. Critically Polluted Areas (CPAs) are the Industrial clusters having 70 and above CEPI scores. Severely Polluted Areas (SPAs) are the Industrial clusters having CEPI scores between 60 & below 70. CPCB through a recognized environmental laboratory periodically monitors the environmental quality in PIAs.

Noise Pollution

Noise is included in the definition of air pollutants in the Air (Prevention and Control of Pollution) Act, 1981. 

Further, for better regulation for noise pollution, there is The Noise Pollution (Regulation and Control) Rules, 2000 under The Environment (Protection) Act, 1986.

Pollution Control Planning

CPCB comes out with Annual Action Plans and coordinates with SPCBs and PCCs for control and abatement of pollution. 

EPR Authorization

Types of EPR Authorization:

• EPR For E-Waste Management
• EPR For Plastic Waste Management
• EPR For Battery Management 

CPCB or SPCB verify the submitted documents and grant EPR Authorization in Form No 1 (AA) within a period of 120 days from receipt of application.

PRO Authorization

The concept of PRO Authorization is available in two sectors:

• Plastic Waste Management
• E-Waste Management

For PRO registration a completely filled application should be submitted to the CPCB.

Clearances

• Environment Clearance: As per the provisions under Environment Impact Assessment Notification, 2006. 
• Forest Clearance: As per the provisions under Forest (Conservation) Act, 1980.
• Wildlife Clearance: As per the provisions under Wildlife Protection Act, 1972
