Eating house License

The first step in understanding the requirements for acquiring an eating house license is to define what an eating house is. "Any place that offers various things linked to food or drink to the general public for consumption is classified as an eating house," according to the definition. This includes all stores, restaurants, dhabas, food trucks, cafes, and other food and beverage establishments. According to the Delhi Police Act, the license must be applied for through the City/State Police Headquarters and the Police Commissioner. Following document verification, the authority will issue the license.

• An eating house license is to be obtained for operating a shop/restaurant / Dhaba / bar/club/café and so on with the Eating facility.
• An eating House is a place to which the public is admitted, and where different kinds of food or drink are supplied for consumption.
• For Eating House License, an applicant has to apply to the State Police Headquarters and the Police Commissioner of that city.

• Identification (Aadhaar, Voter ID, Passport, Electricity Bill, Landline Telephone Bill, Rent/Lease Deed, or Property Ownership Documents)
• Proprietorship, LLP, Partnership, Limited, Private Ltd., Public Ltd., Company Certificate of Incorporation
• Nomination of Authorized signatory/applicant on letterhead; Names of Directors & Current DIR – 12& Board Resolution for conducting business
• Proof of establishment ownership/tenancy/lease (registered sale deed, registered lease/rent deed, GPA, Gift deed, Conveyance deed, Allotment letter).
• A copy of the most recent water bill that has been paid
• A copy of the most recently paid electric bill
• Safety of the Structure the architect/appointed structural engineer issues a building certificate.
• Electrical Safety Certificate from the Electrical Inspector, Labour Department, GNCT of Delhi, or a licensed electrical contractor.
• Is the Eating House equipped with a passenger lift? If yes, please provide the date of the most recent mechanical inspection. Attach a copy of the fitness/safety certificate issued by the Inspector of Lifts, GNCT Delhi's Labour Department.
• Property tax information If so, please upload the receipt.
• Information on the fees paid for regularization. (Only required if building codes have not been followed)
• Information on conversion charges paid under MPD-2021. If so, please upload the receipt. (This is only required if the land use has changed.)
• Parking fees are paid to the Urban Local Body in detail. If so, please upload the receipt. (Not necessary if there is enough parking in the building)
• Proof of water supply source ——- (for CTE & CTO)
• D.G. Set(s) Noise Report (for Concern to operate only)
• Proof of provision for a two-bin solid waste management system: (for Concern to operate only)
• Proof of organic waste converter installation (for Concern to operate only)
• Proof of Rain Water Harvesting Pits Installation (for Concern to operate only)
• A registration certificate was given by the Labor Department of the GNCT of Delhi under the Shops and Establishment Acts.
• FSSAI Certificate. (Required only for Eating Establishments)
• Certificate of GST Registration in the Name of the Establishment
• The Proprietor's/Company's/PAN Firm's
• Explanation of Pest Control Measures (attach certificate)
• Does the establishment allow or plan to allow smoking on the premises? Note: Smoking zones are not authorized in eating establishments with fewer than 30 seats or lodging establishments with fewer than 30 rooms. If no, file an affidavit in the prescribed manner stating the establishment to be a smoke-free zone. If yes, please provide specifics of the smoking space designated in accordance with G.S.R. No. 500(E) of May 23, 2017. (COTPA Act 2003).
• Delhi Police Prescribed Affidavit
• Municipal Bodies' Prescribed Affidavit/Undertaking
• Delhi Fire Service Prescribed Certificate under Rule 35(2) of the DFS Rules, 2010
• Proof of CCTV system installation with 30-day recordings, such as invoice, installation technical report or AMC, pictures, etc.
• Employee list, including name, parentage, and residence, as well as Police Verification Certificate or proof of submission to jurisdictional Police Station.
• Employees' medical certificates with photos
• A list of qualified firefighters (for lodging establishments only)
• The premises/ establishment's sanctioned/approved/as-built plans.
• Project Report describing the unit, proposed capital investment, various activities, number of workers & employees, Manufacturing Process in Detail with a flow chart, raw materials, products & byproducts (quantity per day), details of water consumption & discharge, source of wastewater/ emissions, and proposed pollution control system/measures (details of design & constitute units), as applicable —- (for CTE only)
•  Unit layout plan –In the unit layout plan, measurements and directions must be given so that the exact boundary of the unit may be determined ——- (Only for CTE)
• Proof of plot possession/allotment letter/lease document. Applicant must have a valid rent agreement in the situation of rented premises. ——- (Only for CTE)
• Original authorization letter, unless the individual private concern is involved. ——- (Only for CTE)
• Chartered Accountant's Certificate —- (Only for CTO)
• If appropriate, an ETP/STP effluent analytical report from a DPCC-approved laboratory that is less than six months old —- (Only for CTO)
• If applicable, stack monitoring report(s) from a DPCC impaneled laboratory that is not more than six months old —- (Only for CTO)
• CGWA/DJB/DC Permission/Registration Copies ——(In CTO, optional)
• The concerned authority/local body must provide proof of compliance with the provisions of the Delhi Master Plan. OR a relevant section in the Master Plan demonstrating activity conformance will be used. ————- (Only for CTO).
• Proof from the competent authority (DJB/MCD/NDMC/DCB) that their drainage system is connected to the public/municipal / Delhi Jal Board Sewer. Where units are located in sewered areas, a self-certified undertaking that the unit's drainage system is properly connected to the public/municipal/Delhi Jal Board Sewer will be taken. ————- (Only for CTO)
• A valid license from the Food Safety Department of the Government of the National Capital Territory of Delhi if the units use tobacco as a raw material. —— (in CTO, optional)
• Certificate of Environmental Clearance for a hotel with a built-up area of more than 20000 sq. mts.

• Applicants can file an Eating House License application directly with the government, the process is long & will take 30-60 days.

• Information has to be filed led exactly for the respective application of the Eating House License. All the mandatory documents should be uploaded.
• The chance of the getting application rejected is high. The licensing authority might ask for any other relevant documents if required.
• Once the application gets completed, you are required to meet Addl. Commissioner of Police, Licensing, for scrutiny of your application and other supporting documents.
• You will need to follow up-up with the government department for an update on your application. In c if your application gets rejected because of incomplete information or submitting misrepresented facts, the fees once paid will not be refunded by the government.
• It will take the government agency 30-60 working days to assess your application and grant an Eating House License.

When the license's validity period expires, the license will be renewed. The validity of the license is determined by the issuing body, which differs from state to state. The license is usually good for three years. The process of renewing your license is similar to that of applying for a new one.
