Madhya Pradesh Pollution Board NOC

The MPPCB has been vested with considerable authority and responsibility under various environment legislations to prevent the pollution. M.P. Pollution Control Board presently looks after the implementation of following Acts/Rules:-

• Water (Prevention Control of Pollution) Act, 1974
• Public Liability Insurance Act, 1991
• Environment Protection Act, 1986 (certain sections)
• Madhya Pradesh Jaiv Anaashya Apashista (Niyantran) Act & Rule.
• Air (Prevention & Control of Pollution) Act, 1981 

The main principle of the M.P. Pollution Control Board is to maintain water, air and soil in healthy and usable condition for various purposes. There are 2 Zonal Offices (Jabalpur, Mandideep), 13 Regional Office,   4 District Office, equipped with trained personnel and sophisticated instruments, are constantly keeping watch on environmental activities in the state to attain the objectives.

• To advance the idea of sustainable development, which strikes a balance between social fairness, economic progress, and environmental protection.
• Preventing the waste of natural resources.
• Effective waste management to safeguard the environment. 
• To protect and enhance the environment.
• To persuade the audience that awareness is the key to reducing pollution, and to urge them to use CFLs, paper bags, and public transportation instead of firecrackers, plastic bags, and non-biodegradable products.
• The Madhya Pradesh Pollution Control Board has established standards for businesses and other institutions to follow in order to lessen environmental pollution in the State.
• To entirely improve the environment by the efficient application of laws, rules, and regulations.
• To limit pollution as much as possible.
• To offer assistance to a person or company in choosing locations for the construction of an industry.
• To determine the location and offer guidelines for the creation of hazardous waste disposal processes.
• To give the Madhya Pradesh state government the necessary guidance for the prevention and management of air and water pollution.
• To promote the reuse and recycling of commercial waste and wastewater.
• To set requirements for air emissions and water effluent discharge.
• To work with local governments and the state government on the promotion of treatment storage and disposal facilities and common effluent treatment plants.
• To determine the site where hazardous trash should be disposed of.

Who Needs a Madhya Pradesh Pollution Control Board (MPPCB) NOC?

The Board must approve the installation of any industrial plant, process, treatment system, extension, or addition by a person, unit, or business if it potentially lead to the discharge of sewage or industrial effluent into a stream, well, sewer, or on land. Similar to this, no one is permitted to release any air pollutants that exceed State Board requirements if they propose to construct or operate an industrial facility in an area subject to air pollution regulations (the entire State of Madhya Pradesh has been classified as such). The State Board must give its prior approval for these emissions.

The State Pollution Control Board of Madhya Pradesh must grant industrial facilities classified under the Red, Orange, and Green categories permission to establish and authorization to operate, however those listed under the White Category are exempt from these restrictions. Depending on the Pollution Index of the businesses in each zone, the MPCB categorises industries. The Pollution Index has a scale of 0 to 100, with 100 denoting the most pollutant emissions from units. The following industries are divided into categories:

• Red Category: If the pollution index is 60 or higher,
• Orange Category: Pollution Index ranges from 41 to 59.
• Green Category: Pollution Index calculating from 21-40
• White Category: calculating a pollution index of 20 or less

The MP Pollution Control Board has released a list of industrial units and processes broken down into Red, Orange, Green, and White categories, all of which are fully consistent and similar to the serial numbers in the CPCB list, in order to make it easier to work and share information online through the India E-track Web Portal. Units from the White, Green, Orange, and Red categories are included on the list since it has just been updated.

What are the types of Consent under the MPPCB?

• Consent to Establish/Consent for Establishment (CTE/CFE)

According to Section 25 of the Water (Prevention & Control of Pollution) Act, 1974 and amendments thereto, and Section 21 of the Air (Prevention & Control of Pollution) Act, 1981 and amendments thereto, no person shall establish or operate any industrial plant, operation, process, or treatment or disposal system without the prior consent of the Board. The MPPCB only issues the site-specific CFE order for one particular site. As a result, the representative is required to show the inspector the real project site during the inspection.

• Consent to Operate/ Consent for Operation (CTO/CFO)

Industries are required to obtain Consent for Operation (CFO) from the Madhya Pradesh Pollution Control Board (MPPCB) before operating their units in accordance with Sections 25/26 of the Water (Prevention and Control of Pollution) Act of 1974 and its amendments as well as Section 21 of the Air (Prevention and Control of Pollution) Act of 1981 and its amendments. The MPPCB is issuing CFOs in conjunction with each other. The CFO (new) application must be uploaded by the owner of the company, project, or industry, along with the required documentation and the price.

In order to achieve Consent to Operate (CTO) and Consent to Establish (CTE) in the State of Madhya Pradesh, the Prevention of Water Pollution Act, 1969, was cited. In accordance with Section 5 of the Air (P&CP) Act of 1981, the Air (Prevention and Control of Pollution) Act of 1981, and the Water (Prevention and Control of Pollution) Act of 1974, the Board's rules were also developed. The Project Proponent and Start-ups that desire to operate their business project must first obtain approval before establishing the Project anywhere in the State of Madhya Pradesh. Each Project, Industry, and Non-Industries unit has been classified into one of four categories - Red, Orange, Green, or White - based on the range that it falls under in the Pollution Index and Pollution Potential for Consent management. The project may already be created and operating, thus approval to establish the project is not necessary since the project must have the authorization to operate by the stipulated date.

What are the Documents required to Obtain Consent?

What are the Responsibilities of an Industry as per the MPPCB?

• Upon presentation of credentials, the applicant shall provide the MP Pollution Control Board staff and/or their authorized representative permission to: a. Inspect raw material stock, production processes, reactors, premises, etc. to carry out Board activities.
• To visit the applicant's property to inspect any areas with effluent sources or where records must be preserved in accordance with the terms and conditions of this consent.
• To have access to any records that must be kept in accordance with the terms and conditions of this Consent at reasonable times.
• To examine any monitoring tools or techniques necessary by this consent at reasonable periods.
• To sample any discharge or contaminants at acceptable intervals.
• Industries must install separate electric metering systems for the operation of pollution control devices. These systems must be designed in such a way that any malfunctioning pollution control devices immediately cut off electricity to the production and remain tripped until the malfunctioning pollution control device(s) are fixed.
• A monthly report on the electricity used to run pollution control equipment must be kept and given to the Board.
• The applicant must submit the necessary paperwork, documents, and fees to the board no later than 180 days before a consent or authorization is set to expire.
• The Water Act's section 42(g) and the Air Act's section 38(g) both provide for criminal penalties to be imposed for wilfully making false statements to gain consent or comply with consent requirements.

• The consent (for operation) as required shall be granted to your project after fulfilment of all the conditions mentioned above.  For this purpose, the unit shall have to make an application to the State Board in the prescribed proforma at least 2 (two) months before the expected date of commissioning of your industry.  The applicant shall not operate the unit without obtaining Consent for Operation from the Board and shall not bring in to use any out let for the discharge of effluent and gaseous emission.
• The Consent to Establish is valid for 5 (five) years from the month it is issued. If the industry, institution, or unit does not build or start something, a new permit must be sought, and a charge is also payable.

How are Inspections Conducted as per the MPPCB?

In accordance with sections 26 of the Water (Prevention and Control of Pollution) Act of 1974, section 21 of the Air (Prevention and Control of Pollution) Act of 1981, and rule 5 of the Hazardous Waste (Management, Handling and Transboundary Movement) Rules of 2008, which were made in accordance with the provisions of the Environment (Protection) Act of 1986, the M.P. Pollution Control Board grants consents. Before granting consent or authorization, the project or industry is inspected in accordance with Sections 10 of the Environment (Protection) Act of 1986, Section 24 of the Air Act of 1981, and Section 23 of the Water Act of 1974 to ensure an environmentally safe location and the project's or industry's proper operation-

• Project proposers must submit an online application using the aforementioned ID and password to get the aforementioned consents and authorizations.
• Submit the application's information online together with the required documents.
• Upon completing the requirements for information and documentation, the application is examined by the relevant Regional Office of the MPPCB, and a question is then asked (SMS alert on cell No. Given in application along with online details on online application)
• After completion, of documents and information in principal acceptance is being sentü to PPs online through SMS & Online for submission of consent/authorisation Fees/charges. 
• After submission of necessary Fees/charges, application is released for inspection ofü industry/unit/project with SMS alert to PPs. 

Inspection procedure

Inspection for Consent to Establish (CTE):

Inspection of the unit for Consent to Establish with reference to site specific aspects:

• Verification of information provided in profile and application for consent/authorisation.
• Site details for location of the plant with reference to habitation, eco-sensitive areas, surrounding units, water bodies, monuments, forest etc.
• Layout plan with details of proposed location of source of air pollution (Boiler, furnace, reactor, process emission etc.) and water pollution (ETP, STP, CETP, SLF, treated water disposal area, outlet etc.)
• Confirmation that no construction started at site prior to Consent to Establish.

Consent to Operate (CTO):

Inspection of the unit for consent to establish with reference to site specific aspects: 

• Confirmation that the construction at site is as per proposal submitted for consent to establish. 
• Verification of information provided in profile and application for consent/authorisation. 
• Verification of layout plan with details of location of source of air pollution (Boiler, furnace, reactor, process emission etc.) and water pollution (ETP, STP, CETP, SLF, treated water disposal area, outlet etc.) as proposed during CTE application. 
• Verification of compliance of the conditions given in consent to establish.
• Ensuring the complete installation of air and water pollution Control arrangements (technical specifications) as proposed during CTE {ETP, STP, APCS (Air Pollution Control System)} before grant of Consent to operate.

Authorisation:

Inspection of the unit for grant of authorisation under rule 5 of the Hazardous Waste (Management, Handling and Transboundary Movement) Rules 2008: 

• Verification of information provided in profile and application for obtaining authorisation. 
• Technical details of SLF, storage, piezo meters
• Ensuring that the plant possesses appropriate facilities, technical capabilities and equipment to handle hazardous waste safely.
• Developing the conditions if any to be incorporated in the authorization for proper handling, storage and disposal of hazardous waste.

Renewal of Consent/authorisation (CCA):

The consents and authorisations grated by the Board with conditions as per provisions of Water, Air & Environment Acts. Inspection of the unit for consent renewal:

• Compliances of conditions of CTO/authorisation.
• Ensure submission of periodical returns
