State Pollution Control Board (SPCB) NOC

SPCBs/PCCs are established as per the provisions under the Water (Prevention & Control of Pollution) Act, 1974. They undertake activities in order to protect the environment and prevent pollution. To preserve and protect the environment and also keep a check on environmental degradation, MoEF&CC framed various rules and guidelines for the management of Hazardous Waste, Biomedical Waste, Recycled Waste, Noise Pollution, Municipal Solid Waste, E-Waste, used batteries, etc. CPCB has delegated powers to the SPCBs/PCCs to implement the various Environmental Laws in their respective jurisdiction. What is a Consent?

Any Industrial unit, mining unit, hospital, etc. which might emit air pollutants into the environment or discharge effluents or sewage into a natural stream, pond, land, or any other water body must obtain consent or NOC from the concerned SPCB. SPCBs may use the industry categorization provided by CPCB and they can add additional industries to the list as per the needs and priorities of their respective jurisdiction. Industries are categorized into Red, Orange, Green, and White according to their polluting potential. Primarily Red and Orange categories are considered polluting.

Consent is granted on the basis of this categorization. Consent is obtained in three phases:

• Consent to Establish (CTE) NOC
• Consent to Operate (CTO)
• Renewal of Consent to Operate

What are the Types of Consent?

CTE is to be obtained before constructing/establishing a proposed industry. The required documents should be submitted to the Regional Office of the concerned SPCB. The documents required may vary from state to state. 

After the construction/establishment of the proposed industry and before the beginning of the operations, CTO should be obtained from the concerned SPCB. CTO is valid for a particular period it should be renewed regularly. The required documents should be submitted to the Regional Office of the concerned SPCB. The documents required may vary from state to state. The SPCB issues CTO with the Conditions related to the operation & maintenance of the Pollution Control devices in conformity to the standards prescribed. The validity period of CTO varies for different categories of industries.

The Industrial units have the freedom to apply for CTO for a lesser period by giving justification.

• Being a mandatory requirement to establish any business that might have the potential to pollute the environment, it helps in averting penalties during any audit or inspections by State or Central departments. 
• Once Consent is obtained the process of establishing a business becomes smooth.
• It makes businesses compliant with the Environmental Standards set up by the Government which further contributes to the protection of the Environment and abatement of pollution

What are the different types of State Pollution Control Board Authorization?

Authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016

• Authorization under HWM Rules, 2016
• Authorization under HWM Rules, 2016 for import

All the facilities that are involved in handling Hazardous and other waste are mandated to make an application through Form I to the concerned SPCB and acquire authorization from the SPCB. The application for authorization should be accompanied by the following documents:

• CTE granted by SPCB
• CTO granted by SPCB
• A self-certified compliance report in case of a renewal application

The fees for obtaining authorization may vary from state to state. SPCB, after doing an inquiry grants the applicant authorization in Form 2 for a period of five years. 

Authorization under Bio-Medical Waste Management Rules, 2016

An application in Form II is to be submitted to the concerned SPCB for grant of authorization by every operator or occupier and in charge of a healthcare facility handling bio-medical waste. After carrying out an inquiry and getting satisfied may grant authorization in Form III. With respect to all healthcare establishments of the Armed Forces, Director General, Armed Forces Medical Services under M/o Defence is the prescribed authority for granting authorization.

The validity of authorization for a common facility and a bedded facility is in harmony with the validity of consents.

In the case of non-bedded occupiers, authorization is one-time.

Grant of Registration as Producers, Importers, and Brand Owners (PIBO) and Waste Processors under Plastic Waste Management Rules, 2016

Producers, Importers, and Brand-owners (PIBOs) and Plastic Waste Processors which are operating in one or two states must register themselves with the concerned SPCB/PCC through a centralized EPR portal developed by CPCB.

PIBOs functioning in more than two states and plastic waste processors must register themselves with CPCB through a centralized EPR portal developed by CPCB.

Registration is granted for one year initially and subsequently granted for three years.

Grant of Authorization to Manufacturer, Dismantler, and Refurbisher under E-Waste Management Rules, 2016

• Manufacturer

Any manufacturer generating e-waste must obtain authorization by submitting an application in Form 1(a) to the concerned SPCB. The SPCB after carrying out an inquiry may grant the authorization to the applicant in Form 1(bb).

For renewal application is to be made in Form 1 (a). Authorization is valid for five years.

• Dismantler or Recycler

Any Dismantle or Recycler is mandated to make an application in Form 4 in triplicate to concerned SPCB. The authorization granted is valid for five years and should be accompanied by a copy of the field inspection report. For renewal of authorization, an application should be made in Form 4. SPCB after examining may grant a renewal of authorization for five years.

• Refurbisher

All refurbishers of e-waste should make an application in Form 1(a) in triplicate to the concerned SPCB for the grant of authorization. The SPCB may grant a one-time authorization to the applicant. 

Authorization under Solid Waste Management Rules, 2016

The local body or any other agency authorized by the local body which is involved in the management of solid waste must submit an application in Form I to the concerned SPCB. SPCB after examining may grant authorization in Form II. The validity of this authorization is in synchronization with the validity of the consents.

• Allotment Letter: Land Use classification document indicating the land in an industrial area.
• Layout plan of Project/ Industry
• Power of Attorney/ Authorization Letter/ Board Resolution
• Detailed Project Report

• Aadhar Card of Authorized Signatory
• Pan Card of Company & Pan Card of Authorized Signatory
• MSME/Udyog Aadhar

There may be a requirement of other documents as well which varies from state to state.
