Uttarakhand Environment Protection and Pollution Control Board (UEPPCB)

According to a notification issued by the Forest and Environment Division of the Uttarakhand Secretariat on December 26, 2001, the Uttaranchal Pollution Control Board was constituted in 2001 in accordance with Section (4) of the Water (Prevention and Control of Pollution) Act, 1974. In keeping with the same, the Forest and Environment Division of the Uttarakhand Secretariat rebuilt the Uttaranchal Pollution Control Board. The name of the Uttaranchal Pollution Control Board was changed to the Uttarakhand Environment Protection and Pollution Control Board on July 14, 2003, by the Forest and Environment Division of the Uttarakhand Secretariat. A letter dated on the 11th of December, 2019 from the Uttarakhand Secretariat's Forest and Environment Division, the Uttarakhand Pollution Control Board has replaced the Uttarakhand Environment Protection and Pollution Control Board.

• The implementation of these regulations' requirements and any infrastructure construction for the gathering, storage, segregation, transportation, processing, and disposal of municipal solid waste are the responsibility of each local authority.
• The municipal authority must submit a request for SPCB's approval to establish a site for waste processing and disposal.
• The local authority must abide by these regulations in accordance with the implementation plan listed in Schedule I.
• Before the 30th day of June each year, the municipal authority must submit its annual report to the SPCB, Secretary in charge of Urban Development, and District Magistrate.
• The SPCB is responsible for ensuring that standards for ground water, ambient air, landfill quality, and compost quality, as well as regulations for incineration, are being met.
• Any person, officer, or authority that receives written instructions from the Environment (Protection) Act of 1986 in the course of exercising its authority and carrying out its duties is required to abide by those instructions. The ability to order the closure, prohibition, or restriction of any industry, operation, or process is included in the authority to make directions under this provision. the cessation or control of the provision of power, water, or any other service.
• For the purpose of implementing noise standards for various places, the State Government shall categorize the areas into industrial, commercial, residential, or quiet regions/zones.
• The State Government must take action to reduce noise, including noise from moving vehicles, and make sure that the current noise levels do not exceed the thresholds for ambient air quality set forth in these rules.
• To avoid noise threat and to achieve the goal of keeping the ambient air quality standards in respect of noise, all development authorities, local bodies, and other concerned authorities shall take into account all aspects of noise pollution as a measurement of quality of life when planning developmental activity or carrying out duties related to town and country planning.
• For the purposes of these laws, a silence area or zone may be established surrounding hospitals, educational institutions, and courts that is at least 100 meters in size.
• The authority is in charge of upholding ambient air quality regulations in relation to noise and enforcing noise pollution control measures.

Who Can Apply for Uttarakhand Pollution Control Board NOC?

What Are The Kinds Of Industries Categorized Under The UPCB?

The Ministry of Environment, Forestry, and Climate Change produced notices that limited the operations of several companies (MoEFCC). To assist in deciding where to site these businesses, industries were divided into Red, Orange, Green, and White categories. Later, in order to accomplish a number of objectives, including the regulation of permission and the development of regulations for the inspection and examination of enterprises, the application of this concept was extended to other parts of the country. The primary determinants of categorizing processes have been the size of the enterprises and resource utilization. A pollutant index, or PI, for every industrial enterprise is a number between 0 and 100; a rising PI value denotes a greater pollution burden from that business. The CPCB, SPCBs, and MoEFCC participated in multiple brainstorming sessions that resulted in the following Range of Pollutant Index standard, which has been adopted for establishing industry sectors.

• Red Category: Businesses in sectors with a PI of 60 or above. A dangerous level of pollutants and effluents are emitted from the units in such a region. In ecologically sensitive or protected areas, industries that fall into the red category are not permitted.
• Orange Category: Sectors with a PI between 41 and 59. The orange group includes businesses that produce substantial levels of pollution but considerably less than those in the red category.
• Green Category: Industries create pollution with PI values between 21 and 40. The Green Category includes those whose emissions from businesses are at a moderate level and whose pollution levels are not harmful.
• White Category: Industries are those having PIs of 20 or below. Low or no pollution is produced by these industries. Furthermore, obtaining a CTE or NOC is not required for businesses that fall within the white category.

Inspection of Industries

To ensure compliance, inspection and monitoring must be conducted. As a result of such checks, businesses and other stakeholders perform better environmentally. How To Apply For Consent Under The UPCB?

The Consent System in Uttarakhand is managed by Uttarakhand Online Consent Management and Monitoring System (UKOCMMS).

• Prior to anything else, the sector needs a single screen Id and password.
• There are two types of logins: the first is for board users, known as "SPCB login," and the second is for industry users, known as "single window login (Industry Login)" via through which they can register for Uttarakhand Pollution Board Services.
• After then, the industry must register on a single-window online portal.
• After completing the registration process through the Single Window System, with the help of an approved CAF ID, the unit can apply for different services of the Uttarakhand Pollution Control Board.

The procedure for obtaining Consent to Establish (CTE) and Consent to Operate (CTO) in the State of Uttarakhand dealt with the Uttarakhand Prevention of Water Pollution Act,1969. How Are Applications Renewed As Per The UPCB?

The Uttarakhand Environment Protection and Pollution Control Board (UEPPCB) has provided the Auto Renewal service for CCA (Consolidated Consent and Authorization) application to the Green Category of industry in accordance with Business Reform Action Points - 2017 under Ease of Doing Business. Additionally, with the consent of the Board's Competent Authority, the Auto Renewal Facility for CCA Applications to Orange Category Industries is also made available, provided that the following requirements are met:

• CCA applications that automatically renew will only be taken into account for two years.
• There must not be an increase in the manufacturing process (es), pollutant load, or production capacity that has been approved.
• The MoEF&CC/Central Pollution Control Board's appointed person or agency created and certified a third-party "Audit Report"
• The industry shall submit a "Self-Certification" regarding compliance of earlier CCA conditions. This "Self-Certification" shall be duly certified / verified by the "Occupier" of the industry. 
• The industry is required to produce a "Self-Certification" demonstrating compliance with previous CCA requirements. The "Occupier" of the industry must properly certify and verify this "Self-Certification."
• The Board must act appropriately in accordance with applicable Acts in the event that the predetermined requirements are not met.

Conditions for Renewal

• If neither the manufacturing capacity nor the pollution load rises
• If capital investment does not rise
• Industry will be required to self-certify that the conditions of earlier consent have been complied with. This self-certification must be presented by the industry's recognized representative, who has been duly approved by the business's owner or board of directors.
• Only if CCA is granted for 15 years will auto renewal be taken into consideration. Subject to payment of the renewal tee for the automatically renewed period (Green Category Only).
