CBCB Guidelines for EPR Penalties
The Central Pollution for Control Board has stated regulations and guidelines for the imposition of environmental compensation if, in any case, violation of any of the provisions is witnessed with the said guidelines following the rules that ought to be approved by the Ministry of Environment, Forest and Climate change.
- As a result of non-fulfilment of the obligations outlined in these rules and the use or transaction of false extended producer responsibility certificates, the Central Pollution Control Board shall also establish guidelines for the imposition and collection of environmental compensation on the producer. Following these rules, these guidelines must be approved by the Ministry of Environment, Forest, and Climate Change.
- Any entity aiding or abetting the violation of these rules shall also be held accountable for environmental compensation.
- In these rules, the extended producer's responsibility is not absolved by the payment of environmental compensation. Any extended producer responsibility that has yet to be fulfilled for a particular year may be carried forward to the following year, and so on.
- If the shortfall in extended producer responsibility obligations is addressed after one year, 85 percent of the environmental compensation collected will be returned to the producer.
- If the extended producer responsibility obligation shortfall is addressed after two years, 60 percent of the environmental compensation levied shall be returned to the producer. If the extended producer responsibility obligation shortfall is addressed after three years, 30 percent of the ecological balance levied shall be returned to the producer. After that, no environmental payment shall be returned to the producer.
- If the recycler generates fewer extended producer responsibility certificates due to false information, the registration will be revoked, and environmental compensation will be imposed, which will not be refundable. If these rules are violated three times or more, the registration will be permanently revoked over and above the environmental compensation charges.
- The funds collected under environmental compensation shall be kept in a separate Escrow account by the Central Pollution Control Board. The funds collected shall be utilized in the collection and recycling or end-of-life disposal of uncollected, historical, orphaned e-waste and non-recycled or non-end-of-life disposal of e-waste on which the environmental compensation is levied, research and development, incentivizing recyclers, and financial assistance to local bodies for managing waste management projects and on other heads as decided by the committee.
