CBCB EPR credits from Battery waste recyclers are a form of financial incentive provided to producers who take responsibility for the entire lifecycle of their products. According to the battery waste management rules of 2022, a battery is defined as -

"A new or refurbished cell and Battery and their component, including accumulator, which is any source of electrical energy generated by direct conversion of chemical energy nd includes disposable primary and secondary battery". Besides, it even has four types of batteries, which include- 

• Automotive battery:- A battery used only to power an automobile's starter, lights, or ignition;
• Portable battery:- means a sealed battery, less than five kilograms, not made for industrial purposes, electric vehicles, or to be used as an Automotive Battery. 
• Industrial battery:- This battery is used for industrial purposes, excluding portable, electric vehicle, and automotive batteries. Among these are sealed batteries (excluding potable batteries), unsealed batteries (excluding automotive batteries), and energy storage system batteries;
• Electric Vehicle battery:- Any battery for motor vehicles specifically designed to provide traction for hybrid and electric vehicles.

In addition, producers and manufacturers can earn these credits, and the following are the categories of the manufacturers that can avail of these credits-

The responsibilities of the Producer, Consumer and Recycler are as follows- 

Producer 

• The producer is responsible for adhering to the responsibilities, which say-
• The producer has an EPR obligation regarding the battery introduced in the market to attain refurbishing obligations.
• The producer needs to meet the collection, recycling and refurbishment targets, per the targets mentioned in schedule II of the battery available in the market. 
• The collected waste battery will be sent for refurbishing and not landfilling. 
• Someone, who is involved in the manufacturing of the battery, requires to register through an online centralized portal prescribed in Form 1 with the certificate issued in Form 1 (B) 
• The producer should file a renewal of registration in Form 1 (A) Before sixty days. ) 
• Producer shall provide Extended Producer Responsibility plan in Form 1(C) to Central Pollution Control Board.
• By 30th June of every year for the battery manufactured in the preceding financial year. It shall contain information on
• The quantity and weight of the battery, along with the dry weight of the Battery materials, through the centralized portal.
• (8) Producer shall submit an Extended Producer Responsibility Plan in Form 1(C) to Central Pollution. 

Consumer

• It is the responsibility of the consumer to adhere to the following, which say- 
• To carefully discard the waste battery separately from the other waste streams, from domestic waste streams,
• Ensure that waste batteries are disposed of eco-friendly by providing them to the entity engaged in the refurbishment or recycling.

Recycler

To recycle, one must register with the State Pollution Control Board via the online portal and obtain a registration certificate in Form 2(B). Therefore, the following are the responsibilities of the recycler, which say- 

• One needs to apply in form (A) to the state pollution control board, followed by one-time registration.
• Make sure that activities are carried out according to the provisions of the central pollution control board.
• Make sure that recycling processes and facilities work following the provisions of the Central pollution control board. 
• Ensure that the Waste Battery is removed from the collected appliance if the battery battery is incorporated into the equipment.
• Ensure that the Waste Battery is removed from the collected appliance if the battery battery is incorporated into the equipment.
• Recyclers shall furnish the quarterly returns in Form 4 regarding the information on the quantity of Waste Battery collected or received from various producers or entities, recycled quantities, compliance of material-wise recovery percentage as per recovery targets provided under sub-rule 4 of rule 10, the quantity of hazardous and other waste including solid waste or plastic waste generated after recycling and of such quantity as per extant rules and the quarterly return shall be filed by the end of the month succeeding the end of the quarter. 
• The total quantity of Waste Batteries processed by the entity involved in recycling Waste Battery quarterly will be made available on the portal developed by Central Pollution Control Board and on the entities' websites.

Registration is mandatory for producers, importers, recyclers, and waste processors. State-level operations register with the State Pollution Control Board, while union territories register with the Pollution Control Committee. Those operating in multiple states register with the Central Pollution Control Board through a centralized web portal managed by the CPCB. Corpseed follows these registration rules.

• Submission of forged/manipulated documents by the entities registered under these rules;
• Entities engaged in collection, segregation, and treatment regarding not following sound handling of Waste Batteries.

As per battery waste management rules 2022, These activities may also be dealt with under the provisions of section 15 of the Environment (Protection) Act, 1986, in case of evasion or violation either by the entity itself or help abet any obligated entity evade or violate obligations, after giving an opportunity of being heard.

As stipulated under rule 15, the Central Pollution Control Board shall appoint a committee for implementing Environmental Compensation to prepare and recommend guidelines for collecting and imposing Environmental Compensation from producers and entities. The recommended guidelines shall be submitted to the Ministry of Environment, Forest and Climate Change for implementing such Environmental Compensation.

Payment of Environmental Compensation shall not absolve the producer of the Extended Producer Responsibility obligation set out under these rules. 

Central Pollution Control Board shall levy Environmental Compensation on Producer operating concerning non-fulfilment of their Extended Producer Responsibility targets, responsibilities and obligations in these rules.
