In compliance with the terms of the Water Act of 1974, the Gujarat Government established the Gujarat Pollution Control Board on October 15, 1974. With improved management solutions, the GPCB strives to work towards the improvement of the environment to prevent and control pollution in the State of Gujarat. Although the Board's primary duties have remained those of regulation, it occasionally organizes various awareness campaigns on regional issues like water, air, and land pollution brought on by different industrial clusters, as well as domestic sewage, bio-medical wastes, and plastic issues. To reduce and avoid pollution while also promoting sustainable development, efforts are being made in the area of pollution control. The BIS- Bureau of Indian Standards, Delhi, has registered the GPCB, Head Office, and Gandhinagar under the Quality Management Systems.

The Board's primary goals centre on pollution control and environmental quality protection through sustainable development. Following are the objectives of the GPCB-

• Maximize the reuse and recycling of trade and sewage effluent for industrial and agricultural purposes after proper treatment, thereby reducing water use and operating costs. Due to a decrease in waste discharges into water sources and the receiving body, the practice also aids in preventing water pollution.
• To the greatest extent possible, pollution should be controlled at the source while taking into account technological advancement, commercial feasibility, and the responsiveness of the nearby environment. By establishing disposal criteria and gaseous emission regulations, this purpose is achieved.
• To raise environmental consciousness and prepare the workforce of the future to manage the environmental load, close coordination and teamwork with educational institutions, non-governmental agencies, industries organizations, government institutions, etc., is the proper approach.
• Reduce the negative effects of pollution by choosing appropriate sites for the development of brand-new industrial projects or estate.
• Establishing policies and procedures for the maximum amount of reuse, recycling, and hazardous waste disposal.
• By effectively putting the laws into practice, one can improve the state's environment on all fronts.
• Coordination with other state government agencies and municipal authorities to support e-waste recycling facilities, as well as Conventional Effluent Treatment Facilities and Treatment Stabilization Disposal Facilities.

Who Needs a Gujarat Pollution Control Board (GPCB) NOC?

As per the provisions of “The water ( Prevention & Control of Pollution) Act, 1974; The Air (Prevention and Control of Pollution) Act, 1981 and Hazardous Wastes (Management, Handling and Transboundary Movement) Rules, 2008” any industry that causes to pollute water bodies by releasing harmful effluents into the sea, releases any kind of industry gas or deals with a unit that manages hazardous waste and indulges in the disposal, transportation, storage or treatment of the same has to mandatorily obtain a Consent to Establish (CTE) or a No Objection Certificate (NOC) before starting such business.

The Ministry of Environment, Forestry and Climate Change (MoEFCC) published notices to limit the operation of a number of businesses. To decide where to situate these businesses, industries were divided into Red, Orange, Green, and White categories. Later, the application of this idea was extended to other parts of the country for a number of objectives, such as the control of consent and the development of guidelines for the monitoring and examination of businesses. The primary determinants of categorizing processes have been the scale of the businesses and resource consumption. The possible harm to human health as well as the pollution brought on by the emission of pollutants and effluents were not taken into account. The Pollutant Index, or PI, of any manufacturing industry is a number ranging from 0 and 100; a rising PI value denotes a higher pollution load from that sector. The following Range of Pollutant Index guideline for identifying industry sectors has been finalized following the end of many brainstorming meetings involving CPCB, SPCBs, and MoEFCC.

• Red Category Industries: PI ranging from 60 or a higher. This is an area where pollutants and effluents are released at toxic levels. Industries in the red category are not permitted in ecologically sensitive or protected regions.
• Orange Category Industries: PI ranging from 41 to 59. Industries in this area create high level pollution but are considerably lesser than those in the red category.
• Green Category Industries: PI ranging from 21 to 40. Industries do not create pollution to toxic levels but emissions from enterprises are at a moderate level.  
• White Category Industries: PI ranging 20 or lower. Industries create low to no pollution under this category. It is not mandatory for industries under the white category to obtain a NOC.

Every industry before and at the time of establishment of industries are required to obtain the following consent.

Consent to Establish (CTE): Needs to be obtained before an enterprise has started its operations. It is mandatory for any establishment to apply for a CTE before any operation or function has taken place in an organization. With the aid of the National Informatics Centre (NIC), Gandhinagar, the Government of Gujarat has launched a portal called XGN- extended Green Node so it’s easy for an application to be submitted online as per the provisions of Environmental Laws. Following are the steps to apply for CTE.

• Generate a Password and an ID through the XGN Regional Office.
• In order to understand the correct and easy process of application, a help-desk is set up for the proper understanding of the process which is situated at the Head office at all offices.
• Once the CTE is issued to an organization, an inspection shall be conducted at the site to check if it is suitable to the environment to be set up in a particular area. Any suggestions or additional requirements are instructed by the officers in writing that may relate to the control of pollution and appropriate measures that need to be taken to prevent it. 
• After conducting a thorough profile, the unit is categorised as Red, Orange, Green or White and is further classified as a small, medium or large-scale enterprise based on its investment.

Consent to Operate Consolidated Consents and Authorization (CCA): Such consent is required to be applied for at the start of any business operation. 

• After the establishment of essential machinery or system required for the control of pollution and at the start of the business activity, a CCA shall be applied for in accordance with the laws under the Water Act, Air Act and the Hazardous Waste Rules.  
• Once a CCA receipt is issued, the concerned authority shall install an Environment Management System (EMS) for the purpose of containing and controlling pollution. 
• After rigorous scrutiny by the legal and technical authorities, a CCA shall then be issued to the applicant that consists of various terms and conditions including the need to maintain standards.

How to Obtain a CTE/CCA?

• The organization applying is required to obtain a unique password and a GPCB ID from the respective regional office by submitting relevant details. An applicant can login with their credentials on the GPCB website.
• Follow the steps of the application by carefully filling in important details as mentioned in the application.
• Submit all relevant documents in the form of a PDF in the prescribed format which is 200 DPI, black and white in colour.
• After selecting the option of New Application, the amount that needs to be paid shall appear on the screen. 
• Once the application is carefully checked, the applicant shall receive a message regarding the acceptance of the application. Through the same mode, an applicant shall be intimated in case of any discrepancy.
• A Demand Draft shall be prepared against the fees to be submitted. The details of the DD shall be submitted on the XGN portal.
• Once all the required process has been completed, two printed copies of the application form, a copy of all relevant documents, and the original DD shall be submitted at the respective Regional Office.
• The Procedure to obtain an authorization under Bio-Medical Waste (Management and Handling) Rules, 1998 and Plastic Waste (Management and Handling) Rules, 2011 has a separate procedure altogether, the details of which are on the official website of the GPCB website.

The procedure for obtaining Consent to Establish (CTE) and Consent to Operate (CTO) in the State of Gujarat are dealt with the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981. The Project Proponent and Start-ups who are willing to run their business project must have to obtain consent before the establishment of the Project anywhere in the State of Gujarat. The act requires asking the permission before the establishment of the Project, the Procedure for Obtaining Consent to Establish and Consent to Operate are regulated through Section 25, 26, and 27 of the Water act, 1974 and Section 21 of the Air Act, 1981 along, wherein all the Projects, Industries, Non-industries units have been categorized under four categories that are Red, Orange, Green, and White according to the range under which it comes in the Pollution Index and Pollution Potential for Consent management. The consent to operate has been in operation since 15.04.2014 which has not been covered earlier, from the given date the Project which is already in Operation needs to obtain Consent to operate and there is no need to obtain Consent to Establish permission as such Projects are already established and might be in operation.

• A map that clearly portrays the plan or layout of the entire unit.
• Documents relating to the Ownership of a land (For CTE)
• A Certificate of SSI and a Certificate of Investment that shows the building, land, plant and machinery details all separated.
• An undertaking notarized on a Rs. 100/- stamp paper in the prescribed format.
• A Form-15 as per the Hazardous Waste Rules, 2008 (in case of an accident)
• A Form-VII in the situation where import and export of Hazardous Waste
• Manufacturing process details with a flow diagram.
• If reapplying, a compliance report that shows the reasons in the rejection order.
• Form-4 while filing annual returns under the Hazardous Waste Rules

Important Notes

• A CTE/CCA that are issued are valid for a period of 5 Years.
• The option of renewal is available and shall be applied for before the expiration of the validity.
• All industries applying for the CCA/CTE shall comply with all necessary terms and conditions and shall submit its annual returns on time.

The Fee for the GPCB registration and obtaining authorization prescribed by the Government of Gujarat, Department of Environment, to obtain the Consent to Establish or No Objection Certificate and Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1981, or for the authorization under the Bio-Medical Waste Rules, 1998 differs for Project to Project that is Red, Orange, Green, & white category, depending on the Investment Cost of the Project, and Severity of the project the application fee would be higher for the projects with high investment which may range from (Rs. 100 to more than two lacs).
