Jharkhand Pollution Board NOC

The Water (Prevention and Control of Pollution) Act, 1974's section 4 was first used to create the Jharkhand State Pollution Control Board, which went into operation on December 15, 2001. Currently, it has an elected chairman, fifteen chosen members, and a member secretary who has been appointed. The Air (Prevention and Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, the Water (Prevention and Control of Pollution) Cess Act, 1974, and the Rules framed under the first and third Acts by the State Government and those framed under the second and fourth Acts by the Central Government are all in force in the State.

The provisions of these Acts and Rules are put into effect in the State by the Jharkhand State Pollution Control Board.

• To develop a comprehensive plan for the state's prevention, management, or reduction of stream and well pollution and to ensure its implementation
• To provide state government with advice on any issue pertaining to the prevention, control, or reduction of water pollution
• To gather and spread knowledge about water pollution and methods for preventing, controlling, or eliminating it
• To promote, carry out, and take part in studies and research on issues related to water pollution and the control, prevention, or reduction of water pollution
• To work with the Central Board to plan training for those involved in or about to be involved in programs linked to the prevention, control, or reduction of water pollution, as well as to plan mass education programs related to those programs.
• To review plans, specifications, or other information pertaining to plants set up for the treatment of water, works for its purification, and the system for the disposal of sewage or trade effluents as well as to inspect sewage or trade effluents, works, and plants for treating sewage and trade effluents, as well as in correlation with the grant of any consent as considered necessary by this Act
• Set effluent criteria for the discharge of sewage and trade effluents, for the quality of waterways (other than water in an interstate stream), for the receiving waters' classification, and the receiving waters' quality.
• To develop efficient and trustworthy methods of treating sewage and trade effluents, taking into account the unique soil, climate, and water resource conditions of various regions, particularly the predominant stream and well flow characteristics that make it impossible to achieve even the smallest degree of dilution.
• To develop strategies for using sewage and appropriate trade industrial effluent in agriculture.
• To develop effective ways of sewage and trade effluent disposal on land, which is important due to the prevalent conditions of sparse stream flows that do not provide the minimal degree of dilution for the majority of the year.
• To determine the minimum fair-weather dilution available in a stream and the maximum amount of pollution that can be tolerated in the stream's water following the release of such effluents, and to set requirements for the treatment of sewage and trade effluents to be discharged into that stream.

2. To avoid, restrict, or reduce garbage discharge into rivers or wells
3. requiring any party involved to build new sewage and trade effluent disposal systems, modify, amend, or expand any such existing system, or implement corrective actions necessary to prevent, control, or lessen water pollution. 

• To establish effluent standards for people to adhere to when discharging sewage, sludge, or both, as well as to establish, alter, or revoke effluent standards for sewage and trade effluents.
• To provide the State Government with information regarding the location of any industry whose operation could potentially harm a stream or well.
• To carry out any additional duties that may be imposed on it or that may occasionally be given to it by the Central Board or the State Government.
• For the Board to effectively carry out its duties under this section, including the study of water samples from any stream or well, sewage, or trade effluents, it may construct or recognize a laboratory or laboratories.

Any business that is likely to discharge wastewater or trade effluent into a stream, well, sewer, or on land, as well as any treatment and disposal system, extension, or addition thereto (such discharge being referred to as discharge of sewage).

Based on the Pollution Index, MoEF & CC have divided industries into Red, Orange, Green, and White as shown below: -

• Red Category: Industries with a Pollution Index score of 60 or higher fall under the "Red" category.
• Orange Category: Industrial Sectors in the orange category with a Pollution Index score of 41 to 59
• Green Category: Industrial Sectors with a Green category Pollution Index score of 21 to 40
• White Category: Industrial Sectors with Pollution Index Scores of 20 or above, including the White category

The recently introduced "White" category of industries includes those that are essentially pollution-free, such as the manufacture of biscuit trays and other products from rolled PVC sheet (using automatic vacuum forming machines), cotton and woollen hosier production (dry process only without any dying or washing operation), assembly-only production of electric lamp (bulb) and CFLs, production of scientific and mathematical instruments, and solar power generation using photovoltaic cells (less than 25 MW).

Consent to Establish (CTE)

All new intended projects (developmental and industrial) must obtain "Consent to Establish" (commonly known as a NOC) from the Pollution Control Board Jharkhand in accordance with the provisions of the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981. 

Consent to Operate

All operating units and those beginning operations after a NOC issued by the Board must obtain "Consent to Operate" from the Jharkhand Pollution Control Authority in accordance with the requirements of the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981.

What Is The Validity Of Consent?

The first Consent to Operate will come with a trail permit. Such industrial units must apply for permission to operate through the Online Consent Management and Monitoring System (OCMMS) in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981, respectively, along with documents as per the check list, compliance with CTE and Environmental Clearance (if applicable), and consent fees. If the unit is subject to the Hazardous & Other Waste (Management, Transboundary & Movement) Rules, 2016, it must apply for both. A fee is required for the application of hazardous waste.

The initial CTO will be for One (1) year and will expire after the submission of effluent/air emissions/noise samples, if any are required. The CTO will be revoked/cancelled after the proper procedure is followed.

The validity period of Consent to Operate for various categories of industries/projects under the Water Act of 1974 and the Air Act of 1981 will be as follows:

• Red Category: 5 Years
• Orange Category: 10 Years
• Green Category: 15 Years

The authorization under the Hazardous Waste Management Rules is valid for 5 years, as specified in the Rules.

How is Consent Renewed?

• Industrial units/projects that are already in operation must submit a consent application only through the Online Consent Management System for the renewal of Consent under the Water Act, 1974/Air Act, 1981 and permission under the Hazardous & Other Waste (Management & Tans boundary Movement) Rules, 2016, for the prescribed period depending on the category of the units/projects, along with the documents listed in the Check List and the prescribed consent fees, before 90 days of the expiration date. 
• The Consent will be renewed only for units that meet the pollution discharge standards outlined in the EP Rule of 1986.
• The validity of CTO renewal will be 5 (five) years for Red category units/projects and 10 (ten) years for Orange category units/projects (low and high risk), except for units engaged in reprocessing/ recycling/ dismantling Hazardous Waste/ E-Waste/ Plastic Waste and registered with the Board under the relevant Rules for their said activity. For such units, the CTO will be valid until the expiry date of such registration/authorization or the prescribed validity period of CTO renewal, whichever comes first, depending on the category of the unit. The renewal of authorization under the Hazardous Waste Management and Handling Rules will be valid for 5 years.
• If an industrial unit or project fails to apply within 90 days of the expiry of a previous consent and applies within 60 days of the expiry of a previous consent, the Board will take penal action against such units for not having a valid operating permit under the provisions of the Water Act of 1974/Air Act of 1981. If a unit applies for CTO renewal after the consent period has expired or after taking the aforementioned penal action, such applications will be considered only if the unit submits regular consent fees for subsequent years.

The procedure for obtaining Consent to Establish (CTE) and Consent to Operate (CTO) in the State of Jharkhand are dealt with the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981. The Project Proponent and Start-ups who are willing to run their business project must have to obtain consent before the establishment of the Project anywhere in the State of Jharkhand. The act requires asking the permission before the establishment of the Project, the Procedure for Obtaining Consent to Establish and Consent to Operate are regulated through Section 25, 26, and 27 of the Water act, 1974 and Section 21 of the Air Act, 1981 wherein all the Projects, Industries, Non-industries units have been categorized under four categories that are Red, Orange, Green, and White according to the range under which it comes in the Pollution Index and Pollution Potential for Consent management. The consent to operate has been in operation and has not been covered earlier, from the given date the Project which is already in Operation needs to obtain Consent to operate and there is no need to obtain Consent to Establish permission as such Projects are already established and might be in operation.

The Fee for the registration and obtaining authorization prescribed by the Government of Jharkhand, Department of Environment, to obtain the Consent to Establish or No Objection Certificate and Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1981, or for the authorization under the Bio-Medical Waste Rules, 1998 differs for Project to Project that is Red, Orange, Green, & white category, depending on the Investment Cost of the Project, and Severity of the project the application fee would be higher for the projects with high investment which may range from (Rs. 100 to more than two lacs)
