Puducherry Pollution Control Committee NOC

The Puducherry Pollution Control Committee (PPCC) has been in operation in the Union Territory of Puducherry from 1st of April,1992. It belongs to the Department of Science, Technology, and the Environment as a statutory body. The PPCC recognised the significance of safeguarding the U.T.'s delicate ecosystem and upholding the laws and regulations governing environmental protection. By building a common facility, PPCC is working with private entrepreneurs and other stakeholders to develop a lasting solution. In order to reduce greenhouse gas emissions and counteract ongoing climate change, PPCC supports industry to switch from traditional technology to Clean Development Mechanism (CDM). In addition to adopting command and control policies, PPCC also offers consulting, lobbying, and best practises technology dissemination.

• The Ministry of Environment, Forests and Climate Change has supported the Environmental Information System (ENVIS), which is also being hosted by PPCC.
• In partnership with NGOs, PPCC conducts a number of environmental awareness programmes, such as the World Environment Day celebration and Earth Hour.
• Public hearings are held by PPCC for projects covered by the Environment Protection Act of 1986.

The PPCB lays down the following objectives that are in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.

• To develop a thorough plan for preventing, managing, and reducing air and water pollution.
• To provide guidance to the Puducherry government on any issue relating to the reduction of air and water pollution.
• To gather and spread knowledge about water and air pollution, as well as ways to prevent, regulate, or lessen it.

• Inspecting factories, production processes, control devices, and giving instructions on how to take action to prevent, control, or lessen air pollution
• To check places where air pollution is controlled in order to evaluate the quality of the air there and to take action to prevent, control, or lessen air pollution there.
• To establish, alter, or annually revise regulations for sewage and commercial effluents, as well as for the discharge of any air pollutant into the atmosphere from any other source and the emission of pollutants from industrial facilities and vehicles.

• To gather samples of sewage, trade effluents, and air pollution emissions, and to analyse those samples for particular parameters.

• To carry out any additional duties that the Central Pollution Control Board or the Government of Puducherry may specify.

Notices issued by the Ministry of Environment, Forestry, and Climate Change restricted the operations of various businesses (MoEFCC). Industries were separated into Red, Orange, Green, and White categories to help with the decision of where to locate these enterprises. Later, the application of this concept was expanded to other regions of the nation in order to achieve a variety of goals, including the regulation of permission and the establishment of regulations for the inspection and examination of firms. The scale of the firms and resource use have been the main factors in categorising processes. Every industrial enterprise has a pollutant index, or PI, which ranges from 0 to 100; a rising PI score indicates a higher pollution burden from that business. Following many brainstorming meetings, the CPCB, SPCBs, and MoEFCC developed the Range of Pollutant Index standard that has been used for identifying industry sectors. The industries in the Union Territory are categorized under the following-

• Red Category: This category includes industries that cause heavy pollution and emit toxic levels of effluents into the environment. Their pollution index ranges from 60 and above.
• Orange Category: Businesses that cause significant amounts of pollution but much less than those in the red category are included in the orange category. The Pollution Index ranges between 41 and 59.
• Green Category: The Green Category includes those whose emissions from businesses are at a moderate level and whose pollution levels are not harmful. Pollution Index ranges from 21 to 40.
• White Category: With calculating a PI of 20 or less, industries under the white category produce very less to no pollution. Obtaining a CTE or NOC is not required for businesses that fall under this category.

What Are The Types Of Consent Under The Puducherry Pollution Control Committee (PPCC) NOC?

According to the Puducherry Pollution Control Committee (PPCC) approval is required for the creation and operation of factories under the Water (Prevention and Control of Pollution) Act, 1974, as amended, and the Air (Prevention and Control of Pollution) Act, 1981, as amended. According to section 25 of the Water (P&CP) Act, 1974 as amended, no one shall establish or take any steps to establish any industrial plant or process, any treatment and disposal system, or any extension or addition thereto, which is likely to discharge sewage or trade effluent into any stream, well, sewer, or on land, without the prior consent of the PPCC. A request for the PPCC's consent under subsection (1) must be prepared in accordance with subsection 2 of Section 25 of the aforementioned Act, and it must include all necessary information and any applicable fees. Additionally, according to Section 21 of the Air (P & CP) Act, 1981 as amended, no person shall operate any industrial plant for any industry in an Air Pollution Control area without the prior authorization of the PPCC. A request for the PPCC's consent under Subsection (1) must be made in the required form and accompanied by any fees that may be prescribed, according to Subsection (2) of Section 21 of the aforementioned Act. As per Sub Section (2) of Section 21 of the said Act, an application for consent of the PPCC under Sub Section (1) shall be accompanied by such fees as may be prescribed and shall be made in the prescribed form and shall contain the particulars of the industrial plant and such other particulars as may be prescribed.

All Industrial / Commercial Establishments shall obtain Consent to Establish in the first step before establishing the unit. After obtaining Consent to Establish and 1 (one) month before commencing the Operations the project proponent shall apply for Consent to Operate after fulfilling all the conditions in the Consent to Establish.

What is the Procedure to obtain Consent under the Puducherry State Pollution Control Board?

The Prevention of Water Pollution Act, 1969, addresses the process for obtaining a consent to establish and a consent to operate in the Union Territory of Puducherry. The Board's rules were also created in compliance with Section 5 of the Air (P &CP) Act of 1981, the Air (Prevention and Control of Pollution) Act of 1981, and the Water (Prevention and Control of Pollution) Act of 1974. Before starting their project anywhere in the Union Territory of Puducherry, the Project Proponent and any start-ups who wish to do so must seek permission. According to the range that each Project, Industry, and Non-Industries unit falls under in the Pollution Index and Pollution Potential for Consent management, they have all been divided into four categories: Red, Orange, Green, and White. Since the project must get authorization to operate by the specified date, approval to establish the project is not required because the project may already be established and in operation.

• Total open space in the industrial building that can be used for landscape development, including gardens and green belts. (in sq.mts) 
• Building designs created by a qualified individual include machinery information.
• Total built up area 
• Report on the project, including information about the manufacturing process, a flow diagram of the process, all chemical equations (including the stochiometric equation), and sources of emissions, effluent, dangers, and solid waste
• Water usage breakdown and water balance (process consumption, domestic usage, canteen usage, gardening usage, Boiler usage, other uses as applicable)
• Details of the sewage and effluent treatment plant, including a flow diagram.
• Fuel used, type of boiler, and quantity.

• Puducherry ground water authority approval is required for groundwater withdrawal. 
• Common Biomedical Waste Treatment Facility (CBMWTF) membership letter (for Health care facilities, Pharmaceutical units).

• Consent to Small and Micro scale industries in the Green category: The Consent to Establish and Consent to Operate are collectively offered to industries in Puducherry for a period of 15 (fifteen) years provided the fees of 5 Years is submitted.
• Consent for any other project: CTE is issued for a period of 5 (five) years where 1 (one) year extra is provided by the Board free of any additional costs. 

For Consent to Operate (CTO)

• 30 days before to the operation's commissioning, the industries are required to submit an application for the industry's Consent to Operate.
• The industry will be inspected by the Concerned Officer to ensure that all the requirements outlined in the consent for establishment have been met.
• The aforementioned report will be examined, and permission to operate will be granted.

1. Red Category (Large, medium and Micro Scale industries) - 5 years 
2. Orange Category (Large, Medium and small-scale industries) - 10 Years 
3. Orange Category (Micro Scale industries) - 10 years with fees only of 5 years
4. Green Category (Large Scale Industries) - 15 Years
5. Green Category (Medium Scale Industries) - 15 years with fees only of 10 years
6. Green Category (Micro and Small-Scale Industries) - Combined CTE and CTO for 15 Years with a 5 Year fees. 

• (30) The industries are required to file an application for the renewal of the prior operating consent thirty days before it expires.
• The application must be submitted through OCMMS. To make sure that all conditions stated in the consent for establishment have been satisfied, the concerned authority will inspect the company.
• Consent renewal will only be granted following complete completion of all requirements set forth in the prior consent order.

Documents required for Renewal of Consent

• Break-up of water uses and water balance. (process consumption, domestic usage, canteen usage, gardening usage, Boiler usage, other uses). 
• Details of manufacturing process, with process flow diagram and all chemical equations (stoichiometric equation). 
• Environmental statement (form-V). 
• Information on techniques to reduce air pollution: stack and chimney placement for process and flue gas emissions.
• Steam-generating certificate for a boiler that shows how much steam is produced and how much coal is consumed each day, duly approved by the boiler inspector's office (in case of IBR Boiler).
• List of raw materials, together with monthly (MT/M) quantities.
• Product/by-product list with monthly quantity (MT/M).
• MSDS in case of chemical industries 
• For ground water intake, Puducherry ground water authority permission 
• Details of HW as per 2016 amended rules or for all categories with Quantity, for Reception (Reprocess or Re-cycler), Generation, Collection, Storage, Treatment (Details of Method) and Disposal (Details of Method if applicable). 
• Information about the applicant's actions to recycle or reuse, or to reduce and prevent waste generation. An attached copy of under taking for the same shall also be submitted.
• The NABL, a MoEF-accredited laboratory, has produced a third-party analysis report on waste water analysis, source sampling, and ambient air quality analysis.
• Copy of a food and drug advertisement (in case of Pharmaceutical industry).
• CRZ regulatory authorization in the event that the unit falls within.
• Projects needing environmental clearance must obtain it from the MoEF or the SEIAA.
