Sikkim Pollution Control Board NOC

Under the terms of Sub-Section (1) of Section 4 of the Water (Prevention & Control of Pollution) Act, 1974, the State Pollution Control Board (SPCB) Sikkim was established as an autonomous agency in 2008. SPCB-primary Sikkim's duties include acting as a regulatory body and an advisory body.

SPCB-Sikkim advises the state government with the steps that should be taken for pollution prevention, control, and elimination as part of its advisory role.

Under the regulatory function, the SPCB - Sikkim is bestowed with the power of implementation of different Acts and Rules pertaining to Environment Pollution Control. The State Pollution Control Board-Sikkim implements the following Acts and Rules in the State of Sikkim.

• Each local authority is responsible for carrying out the provisions of these laws and building any necessary infrastructure for the collection, storage, segregation, transportation, processing, and disposal of municipal solid waste.
• To establish a location for waste processing and disposal, the municipal authority must submit a request for the SPCB's permission.
• These rules must be followed by the local government in accordance with the implementation plan.
• The municipal authority is required to submit its annual report to the SPCB, Secretary in charge of Urban Development, and District Magistrate by the 30th day of June each year.
• The SPCB is in charge of ensuring compliance with rules regarding incineration as well as standards for ground water, ambient air, landfill quality, and compost quality.
• When exercising their authority and performing their obligations, every person, officer, or authority that receives written instructions from the Environment (Protection) Act of 1986 is required to follow those instructions. The power to issue directives under this clause includes the right to demand the shutdown, banning, or restriction of any sector of the economy, operation, or procedure. power, water, or any other service provision being stopped or controlled.
• The State Government must classify the areas into industrial, commercial, residential, or quiet regions/zones in order to apply noise standards for different locations.
• In order to ensure that the existing noise levels do not exceed the limits for ambient air quality specified in these regulations, the State Government shall take steps to reduce noise, particularly noise from moving vehicles.
• All development authorities, local bodies, and other concerned authorities shall consider all aspects of noise pollution as a measurement of quality of life when planning developmental activity or carrying out duties related to town and country planning in order to avoid noise threat and to achieve the goal of maintaining the ambient air quality standards in respect to noise.
• For the purposes of these rules, a silence area or zone of at least 100 meters in circumference may be formed around hospitals, institutions of higher learning, and courts.
• The authority is in charge of enforcing noise pollution control measures and maintaining ambient air quality laws in regard to noise.

According to their potential for pollution, SSPCB-Sikkim has divided the numerous industries present in the state into four groups: Red, Orange, Green, and White. Accordingly, a Consent to Establish (CTE) and Consent to Operate (CTO) are issued. According to the classification of industries, the consent fee is determined for each industry. • Red Category: Heavily Polluted; Businesses in sectors with a PI of 60 or above. A dangerous level of pollutants and effluents are emitted from the units in such a region. In ecologically sensitive or protected areas, industries that fall into the red category are not permitted.
• Orange Category: Moderately Polluted; PI between 41 and 59. The orange group includes businesses that produce substantial levels of pollution but considerably less than those in the red category.
• Green Category: Less Polluted; PI values between 21 and 40. The Green Category includes those whose emissions from businesses are at a moderate level and whose pollution levels are not harmful.
• White Category: Almost not polluted and having PIs of 20 or below. Low or no pollution is produced by these industries. Furthermore, obtaining a CTE or NOC is not required for businesses that fall within the white category.

• Consent to Establish

All new intended projects (developmental and industrial) must obtain "Consent to Establish" (commonly known as a NOC) from the Sikkim State Pollution Control Board in accordance with the requirements of the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981.

• Consent to Operate

All operating units and those beginning operations after a NOC issued by the Board must obtain "Consent to Operate" from the Sikkim Pollution Control Authority in accordance with the requirements of the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981.

What is the procedure to apply for Consent under the SSPCB?

When applying for permission to operate and permission to establish in the State of Sikkim, the Prevention of Water Pollution Act, 1969, was cited. In accordance with Section 5 of the Air (P &CP) Act of 1981, the Air (Prevention and Control of Pollution) Act of 1981, and the Water (Prevention and Control of Pollution) Act of 1974, the Board's rules were also developed. The Project Proponent and Start-ups that desire to operate their business project must first obtain permission before establishing the Project anywhere in the State of Sikkim. Each Project, Industry, and Non-Industries unit has been classified into one of four groups based on the range that it falls under in the Pollution Index and Pollution Potential for Consent management:  Red, Orange, Green, and White. Since the project must get authorization to operate by the specified date, approval to establish the project is not required because the project may already be established and in operation.

What are the documents required for Consent?

• PAN Card/Aadhar Card/ Voter ID
• Registered land Documents- Land Possession Certificate (LPC), Lease Deed, Sale Deed, and Land Receipt
• Project Report, which includes the proposed pollution control methods, the overall project cost, project specifics, and the manufacturing process.

• An undertaking about compliance with CTE/CTO conditions (in the required format) and supporting documentation, such as photos and receipts for the machinery and pollution control measures that were purchased.

For the Red, Orange, and Green category of industries, the Consent to Operate (CTO) will be renewed with a validity duration of 2 years, 3 years, and 5 years respectively. 

What Is The Procedure For Inspection As Per The Sikkim State Pollution Control Board (SSPCB)?

• Red Category Industries: Once in 3 months; Small and Medium Scale: Once in 12 months
• Orange Category Industries: Once in 6 months; Small and Medium Scale- Once in 3 Years
• Green Category Industries: Only conducted if a complaint is raised or if self-certification not conducted.

The rules of various environmental laws often allow inspection teams made up of two or more officers to conduct inspection. On the entry of premises, the team serves a notice of entry & inspection to the responsible person / occupier of the premises. During inspection, in the presence of the responsible person / occupier of the premises the team carries out inspection, which includes, verification of:

• Operation of plant(s),
• Product(s) being manufactured with quantity,
• Status of operation of Environment Management System comprising of control measures for liquid, gaseous and solid wastes,
• Generation of liquid, gaseous and solid wastes & their disposals,
• Maintenance of records in the form of logbooks etc.,
• Availability of various utilities and consumption of resources viz. water, fuels, electricity, etc.,
• Number of outlets provided for disposal of liquid effluent and compliance of thereof vis b-vis conditions in the consent granted,
• Number of emission stacks / vents / boilers etc. and compliance of thereof vis-a-vis conditions in the consent granted.

During the inspection and verification of the industrial unit the team will collect the sample(s) of waste water, gaseous emission(s) and hazardous waste(s), as and where the team feels necessary, depending upon the environmental circumstances during the visit. At the end, the monitoring team issues written instructions to the industry for the non-compliances observed, if any, and they are brought to their notice with required corrective measures.
